"Inconceivable that the government would break into a lawyer's office (early in the morning) - nearly unheard of", Trump wrote on Twitter.
United States President Donald Trump's former personal lawyer Michael Cohen has secretly recorded a conversation he had with Trump discussing payments to a former Playboy model who claimed she had an affair with the president, The New York Times reported quoting lawyers. New York, where the taping reportedly took place, legally requires only one person's consent for such a recording.
But, possibly in reference to questions about whether he had violated any campaign finance laws, Trump added that "your favorite President did nothing wrong!" He said the tape would show that Trump makes it clear that if there is going to be a payment, it should be done by check, which would be easily traced.
Attorney Lanny Davis said Friday the recording won't hurt his client, former Trump lawyer Michael Cohen. Giuliani confirmed the existence of the recordings, which are in the possession of the Federal Bureau of Investigation, and told reporters Friday that the tapes would be exculpatory for Trump.
"Nothing in that conversation suggests he had any knowledge of it in advance", Giuliani said.
"In the big scheme of things, it's powerful exculpatory evidence", he added.
As for the legality of recording a private conversation, the content of what is on the alleged tape matters.
The existence of the audio recording was first reported by the New York Times, which said Trump and Cohen discussed a potential payment to McDougal.
"So not only is suggesting that Cohen committed a crime in recording him, but to accuse his former lawyer, who simply said may have the goods on him of committing the crime is a bad, awful idea", Specter continued.
The White House has said Trump denies having sex with Daniels.
Michael Cohen, President Donald Trump's personal lawyer and longtime fixer, leaves federal court in NY.
Michael Cohen recorded the conversation with Trump, which was seized by federal agents.
The story of the affair broke four days before the elections, but Trump's payout is a new revelation. A Trump adviser said Trump suggested using a check, while a person close to Cohen claimed Cohen was the one who advised that route. "Any attempt at spin cannot change what is on the tape".
But the supermarket tabloid did not publish her kiss-and-tell, and she had said she was tricked.
She claims they had a months-long affair in 2006, shortly after Mr Trump's wife Melania gave birth to Barron, their son.
At this point, Cohen has not has any conversations with prosecutors in the Southern District of NY, one source says.
"Obviously, there is an ongoing investigation, and we are sensitive to that", Davis said.
According to CNN, "McDougal signed a contract with American Media Inc., the company that owns the National Enquirer, which barred her from publicly speaking about the alleged affair before the 2016 election".
