Pence said that Kavanaugh had 12 opinions that were later adopted by the Supreme Court, and rebuffed Schumer and his Empire State colleague Sen.
Pence himself inadvertently added to those concerns on Tuesday, when asked whether he still supported overturning Roe v. Wade. Roe v. Wade goes further than the NY state law.
The Senate has a 50-vote threshold to confirm a Supreme Court justice.
"We never passed the New York State law because we relied on Roe v. Wade and everyone assumed it would always be there", Gov. Cuomo said.
Legal experts, however, aren't convinced that Kavanaugh's presence alone would automatically lead to the overturning of Roe and the 1992 landmark case Planned Parenthood vs. Casey, which upheld large parts of Roe and ruled that states can not impose an "undue burden" on patients seeking abortion. "I am pro-life in terms of legislation that passes through the House, but I do think the Supreme Court has settled that issue generationally".
The campaign includes a new digital ad "Vote for Roe or We'll Vote You Out", as well as robust six figure TV ad buy championing what the governor said is his "record on women's rights". But she also said it is important to recognize the role played by a conservative Republican president.
"My message is to the Democrats who think resistance is just a hashtag", he said to protestors outside of Trump's skyscraper on Fifth Avenue and East 56th Street.
Cohen thinks the more likely scenario is for the majority-conservative Supreme Court to incrementally chip away at abortion access with a series of rulings, a strategy some call "death by 1,000 cuts".
