The main theory is that the Model S had reduced its speed from 60 miles per hour to 55 miles per hour to match a vehicle in front but sped up again automatically to the preset of 60 miles per hour after the auto ahead changed lanes.
The police report, which was obtained Thursday through an open records request, provides detail about the vehicle's actions immediately before the May 11 crash and the driver's familiarity with its system. Yet, the National Highway Traffic Safety Administration has employed an investigation team to Utah for investigating the case.
It is notable that Tesla has refused to agree to one of the seemingly reasonable requests of the plaintiffs - that it reimburse them the cost of the system - another pointer that the company is rapidly running out of money.
Tesla said Friday it has agreed to make payments to customers around the world as part of a settlement to a class-action suit involving the electric carmaker's sometimes controversial Autopilot assisted-driving system. She told police she was looking at her phone and comparing different routes to a destination.
Police say vehicle data show Lommatzsch did not touch the steering wheel for 80 seconds before the crash. Earlier, the Tesla Model X was crashed on Highway 101 of Mountain View in March, the driver also warned by the Autopilot of the auto to put his hands on the wheel.
The driver who was sitting in the firetruck when it was hit suffered a minor injury consistent with whiplash, according to the report, while Lommatzch broke her ankle.
Tesla Inc on Thursday reached an agreement to settle a class action lawsuit with buyers of its Model S and Model X cars who alleged that the company's assisted-driving Autopilot system was "essentially unusable and demonstrably risky". However, Steve Berman, the lawyer of the company has not commented yet. According to the deal, Tesla agreed to compensate those who have bought 2.0 version of Autopilot vehicles and had to wait long for its promised features to get activated.
"Since rolling out our second generation of Autopilot hardware in October 2016, we have continued to provide software updates that have led to a major improvement in Autopilot functionality", the company said.
Prior to this accident, in January, on a Southern California freeway, Model S hit a parked truck.
Autopilot has come under intense scrutiny of late since a fatal accident involving a Tesla Model X vehicle occurred in March.
Two 18-year-olds were trapped and died in the blaze. However, the agency said that the regulators have not yet assessed its effectiveness.
This week, Tesla said Autopilot was not engaged when a Model S veered off a road and plunged into a pond outside San Francisco, killing the driver.
